Mexicana GO

1.- GENERAL TERMS AND DEFINITIONS.

• MexicanaGO: Is a Loyalty Program that offers Benefits and Rewards to its Members.
• The Administrator: The Servicios Frecuenta, S.A. de C.V. Company, creator, developer and manager of MexicanaGO.
• MexicanaGO Website: www.MexicanaGO.com
• GO Point: Is the basic MexicanaGO currency unit. The Administrator guarantees its value and existence.
• GO Member: Is a MexicanaGO Member who abides by these Terms and Conditions.
• GO Level: In order to differentiate GO Members and their corresponding benefits, MexicanaGO will determine a number of levels suited for such purposes, which will be subject to changes or even elimination determined by MexicanaGO without previous notice or Member approval. MexicanaGO will establish validity Rules for each level, which will be displayed and kept up to date in the MexicanaGO Website.
• MexicanaGO Card: It is a physical or electronic (virtual) card devised to identify a Member's Account Number and GO Level. GO Cards belong to MexicanaGO and will be issued in the name of each member. Therefore, they can be withdrawn at any given moment and without previous notice or Member consent by MexicanaGO. It is the member's responsibility to keep his/her contact information up to date in order to receive its physical or electronic card according to corresponding GO Level.
• GO Account: It is the registration of a MexicanaGO Member, endowing him/her with a unique, personal and non-transferable account number. The Administrator holds the right to audit GO Accounts at any time.
• GO Partner: It is any company that offers its products or services as benefits or Rewards for MexicanaGO. GO Members acknowledge and accept that MexicanaGO does not guarantee or cannot be held responsible for any obligation acquired by a GO Partner in providing any benefit or reward outside of MexicanaGO reach.
• GO Points Accumulation Policy: The Administrator will keep the accumulation opportunities and rules applying to each negotiation with GO Partner up to date and displayed at the MexicanaGO Website. The administrator holds the right to add or eliminate GO Partner and/or accumulation opportunities at any given time and without previous notice or need of consent.
• GO Points Use Policy: The Administrator will keep the accumulation opportunities and rules applying to each negotiation with GO Partner up to date and displayed at the MexicanaGO Website. • For any matter concerning interpretation and application of the Terms and Conditions here displayed the parts remain bound to what is stated by the laws of Mexico and to the jurisdiction and authority of the Mexico City, Federal District Court.
• The Administrator holds the right to modify at any given time these Terms and Conditions, rules, policies and/or any other aspect relative to MexicanaGO. The up to date version of these Terms and Conditions will be published at the MexicanaGO Website.

2.- SUBSCRIPTION TO MEXICANAGO.

• GO Members must provide their personal data, including a personal email address, so such member will be pre-registered at MexicanaGO and will be able to accumulate GO Points. No members will be accepted by MexicanaGO unless they provide their email address.
• I order to validate MexicanaGO benefits, GO Members shall complete the Program registration process activating their GO account by confirming their registration through the activation email that will be sent to the email address provided. In the event a Member does not confirm his registration through the activation email, such Member shall not be entitled to use any service (GO on-line information access, internet, etc.) and/or additional benefits to GO Points accumulation (Points use, promotions, etc.).
• When signing up to MexicanaGO, the GO Member agrees to receive the account statement and any other information issued by MexicanaGO and GO Partner by electronic media such as e-mail in a time and frequency determined by MexicanaGO. If the e-mail address should be not up to date, MexicanaGO will not be held responsible if the Member does not receive his/her information in time or at all.
• To assure the validity of any accumulation, or for any clarification, the GO Member must be registered according to information portrayed on official identity documents (Voter Credential or Passport).

3.- GO POINTS ACCUMULATION AND USE.

• The GO Member can accumulate GO Points according to the current Accumulation Policies for GO Points.
• Accumulated GO Points in GO Accounts will belong exclusively to the Membership Owner and can only be used or transferred based upon the current GO Points Use Policies.
• GO Members can use their GO Points, on any available flight seat with Mexicana to any destination. The amount of Points can vary according to the season and the flight availability.
• Once the transaction, purchase or transfer of GO Points has taken place, there will be no reinstatements or refunds.
• Every reward or service obtained with GO Points is subject to Terms and Conditions, determined by the GO Partner or third party provider.
• MexicanaGO may charge for its services and such fee can be modified without previous notice. When performing any transaction involving GO Points, the GO Member agrees to pay the corresponding fee for which he was previously made aware.

4.- GO ACCOUNT CANCELLATION.

• The Administrator holds the right to cancel GO Accounts including all accumulated GO Points when no sign of activity is detected in such account for a period of 18 consecutive months.
• The Administrator holds the right to cancel any GO Account due to any unauthorized use by its owner or any other person (this matter is subject to investigation).
• GO Members whose Accounts have been cancelled along with the corresponding GO Points will not be allowed to any reinstatement of such GO Account or the refunding of the cancelled GO Points.
• Any transgressor will be held responsible for damages to the Administrator and/or MexicanaGO and will be charged for any costs or expenses derived from this action, including any lawsuit if that should be the case.
